These Terms of Service (“Terms”) govern your use of the Mama Cookie website and your purchase of Mama Cookie products from LU AND LU TRADING LLC (“Company,” “we,” “us,” or “our”). By using this website, submitting a contact form, or purchasing a product, you agree to these Terms.

Important: These Terms include a binding arbitration agreement and class-action waiver. Please read them carefully.

1. Products and availability

Mama Cookie products are sold as limited direct-sale inventory. Product descriptions, photos, prices, and availability may change at any time. We may limit quantities, refuse or cancel orders, or discontinue products at our discretion, including where inventory is unavailable, order information appears inaccurate, or fraud or abuse is suspected.

2. Pricing, taxes, shipping, and payment

Prices are listed in U.S. dollars. Payment processing is handled by Stripe or another third-party processor. Shipping charges and applicable taxes are shown during checkout before payment. We currently ship to U.S. addresses only unless we expressly agree otherwise in writing.

You represent that you are authorized to use the payment method provided and that all purchase and shipping information is accurate. Title and risk of loss pass to you when the order is delivered to the shipping carrier, except where applicable law provides otherwise.

3. Returns and refunds

Because this is limited direct-sale inventory, return requests must be submitted within 14 days after delivery. Returned products must be unused, unwashed, and in their original condition and packaging unless we approve otherwise in writing. Buyer pays all return shipping. Original shipping charges are non-refundable unless we choose otherwise in writing. We may reject returns that do not meet these conditions.

4. Product use and responsibility

Products are provided for ordinary consumer use. You are responsible for reviewing all product information, using products safely and appropriately, and supervising any use around infants or children. To the maximum extent allowed by law, we disclaim responsibility for misuse, unsafe use, or use inconsistent with product instructions or ordinary care.

5. Website content and intellectual property

The Mama Cookie name, website content, product images, text, graphics, logos, and related materials are owned by or licensed to LU AND LU TRADING LLC. You may not copy, scrape, reproduce, modify, sell, or use our content for commercial purposes without written permission.

6. User communications

When you submit a contact form or other communication, you agree that the information is accurate and lawful. You may not submit spam, malicious code, false information, abusive content, or content that infringes another person’s rights. We may ignore, delete, or block abusive or suspicious submissions.

7. Disclaimers

The website and products are provided “as is” and “as available” to the maximum extent allowed by law. We disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so some limitations may not apply to you.

8. Limitation of liability

To the maximum extent allowed by law, LU AND LU TRADING LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or loss of goodwill arising from your use of the website or purchase or use of products. To the maximum extent allowed by law, our total liability for any claim related to a purchase will not exceed the amount you paid for the product giving rise to the claim.

9. Indemnity

You agree to indemnify and hold harmless LU AND LU TRADING LLC and its owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorney fees, arising from your misuse of the website or products, violation of these Terms, or violation of another person’s rights.

10. Binding arbitration, class waiver, and forum selection

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, or any product purchase will be resolved by binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small-claims court or seek injunctive relief for intellectual-property misuse or unauthorized website activity.

Arbitration will be conducted on an individual basis only. You and LU AND LU TRADING LLC waive any right to participate in a class action, class arbitration, consolidated action, private attorney general action, or representative proceeding.

Unless applicable law requires otherwise, the arbitration will be administered by a neutral arbitration provider designated by LU AND LU TRADING LLC, and the arbitrator will be selected according to that provider’s rules or another procedure selected by LU AND LU TRADING LLC that is permitted by law. The seat and forum for arbitration will be Clark County, Washington, unless we choose another location or agree to remote arbitration. Washington law governs these Terms, without regard to conflict-of-law rules.

If any part of this arbitration agreement is found unenforceable, the remaining parts will continue to apply to the maximum extent allowed by law.

11. Changes to these Terms

We may update these Terms at any time by posting a revised version on this page. The updated Terms apply to website use and purchases after the effective date shown above.
